Terms & Conditions
This membership bills every month. The first payment is due on the membership's start date. This membership entitles the purchaser to a full or partial discount on events/classes offered by the business. Some classes/events may be excluded from this membership. Unless otherwise noted, this membership is non-transferable. Your payment details will be securely stored in our system for the duration of the membership. This membership cannot be cancelled early. The full 2 months must be purchased to receive the rate listed.
These are the general terms and conditions for all memberships.
1. Each member attends Richard Clarke Health and Fitness of their own free will.
2. In respect of any monthly memberships (i.e, month-to month, 3. 6, or 12 Month Programmes), Members can only cancel their membership once their initial monthly commitment has passed, you can then give a months notice. Once the initial monthly commitment has expired the member’s membership will continue on a rolling monthly basis unless a further fixed terms is entered into.
3. Members can only cancel their membership once their monthly commitment has passed. If the client cancels their membership payments before the end of their agreement without reason, this will be passed on to our credit control department.
4. The client is liable for £150 administration fee for breach of this agreement.
5. If a member suffers an injury and is advised by their GP not to exercise then membership can be suspended until able to exercise again. Similarly if you lose your job or move house, your membership can be paused or suspended. We reserve the right to ask for written confirmation of this.
6. In respect of the 12 Week Programmes, completed at Birchgrove or Llanrhidian, or ONLINE, this membership will automatically end on expiry of the 12 week period. You may then enter into another Richard Clarke Health and Fitness membership. We will contact you to check if you wish to continue 3-4 weeks before expiry.
7. In respect of Fixed Upfront Membership, this membership will automatically end on expiry of the specified fixed period.
8. You may then enter into another Richard Clarke Health and Fitness membership. If a Fixed Upfront Membership is terminated prior to the expiry of the agreed fixed period there will be no refund of the membership fee, which will have been paid upfront, however online programme access can be given in its place.
9. If the client wishes to cancel their membership payments before the end of their agreement for such reasons as moving away, job location change, they will be required to either pay £100 administration fee or 1 months payments in notice as preferred. This does not apply to a Fixed Upfront Membership for which, as per clause 8 above, there will be no refund of the membership fee in the event that it is terminated prior to the fixed period expiring.
10. If a member suffers an injury or becomes pregnant and is advised by their GP not to exercise then any membership can be put on hold until able to exercise again. We reserve the right to ask for written confirmation of this. If a member is not able to return to exercise due to the injury or illness, one month’s payment in notice is required.
11. Membership fees must be paid on the agreed start date and, monthly (if applicable) via TeamUp.
12. Each member must complete a health waiver prior to training, and agree to its terms and conditions.
13. It is the sole responsibility of every member to inform the instructor of the class of any injury or reason that they cannot train or exercise.
14. Should any member feel any injury at any time during Exercise, they must immediately inform the instructor and refrain from training until they seek professional medical advice to do so.?
15. The instructions and directions given by the instructor are done so at their own discretion and must be adhered to for the safety of each individual unless (see next point). If any member feels for any reason that they cannot do the exercise or activity in the class/session, they must inform the instructor, who may in turn, at their own discretion, suggest an alternative if he/she feels suitable, or refrain from doing that exercise/activity on that occasion.
16. The Richard Clarke Health & Fitness instructor cannot be held responsible for injuries caused during the course of the training session as injuries are possible, save to the extent that such injuries are caused by the negligence of a Richard Clarke Health and Fitness instructor. In particular, there will be circumstances in which training is conducted in other locations and/or remotely, it is the member’s responsibility when being trained remotely to ensure that the area is safe to train in.
17. Richard Clarke Health and Fitness sessions occasionally go outside the parameters of a standard fitness training program, that you may be used to (in the gym etc.) and each member attends of their own free will.
18. Richard Clarke Health and Fitness cannot be held responsible for lost, damaged or stolen property during any training session or any time at our facility.
19. Richard Clarke Health and Fitness instructors or team will not mind member’s property during training, i.e. jewellery, keys etc.
20. Classes, times and locations are subject to change and cancellation. In such cases alternative classes and/or locations will be offered.
21. If you miss classes for whatever reason, work, holidays, family engagements, injuries, illness, laziness etc, we WILL NOT give refunds you can however, attempt to arrange a replacement class in that same week. Members must re-book using TeamUp or speak to the admin team prior to attending replacement class. In addition, there may be circumstances in which training at a location is against official guidance/advice, prohibited by law or otherwise impossible for reasons beyond Richard Clarke Health and Fitness control, in such circumstances Richard Clarke Health and Fitness will do its upmost to provide an alternative training option (such as online training) but in the event this is impossible it shall not entitle you to a refund of your membership fee.
22. Notices will be posted via email, on the Facebook page or website so it is up to each member to regularly check this for updated information.
23. It is the responsibility of each member to clearly give either a mobile number and email address at registration, where they can be reached up to 1 hour prior to any training session.
24. Should your contact details change while you are still a Richard Clarke Health and Fitness member, you must notify Richard Clarke Health and Fitness Staff by email with your new contact details and update TeamUp.
25. Each member must wear appropriate training attire during any class or activity. Should you not know what the appropriate attire is, you can contact Richard Clarke Health and Fitness to clarify.
26. Should the scheduled instructor not be present for a training session; alternative arrangements may be made for the session. This may include a temporary replacement or otherwise. This decision will be up to the discretion of Richard Clarke Health and Fitness organisers.
27. It is the responsibility of each member to inform the instructor if they feel they require additional warm up or cooling down at any class.?Richard Clarke Health and Fitness classes are run with an 'at your own pace' policy; however, the instructors and team are there to push you to train at your hardest. If you feel that you cannot keep up the pace that is being set for you, it’s up to you to pull out or to mention it to the instructor that you will train at a lesser pace.
28. Richard Clarke Health and Fitness instructors and/or team use terms and phrases throughout the classes to encourage and motivate members, it is not our intention to offend anyone, so please don’t take it personally.
29. ?Any activities, social nights, holidays, hikes etc. put on by Richard Clarke Health and Fitness may have additional charges, which will be clearly outlined on announcement or prior to event.
30. It is up to each member to arrange their own insurance for any of these events or similar, you will not be insured by Richard Clarke Health and Fitness.?Richard Clarke Health and Fitness instructors are not responsible for Richard Clarke Health and Fitness members during any activities, social nights, hikes, weekends away, games, runs, etc. organised during any session.?
31. Richard Clarke Health and Fitness have the right to refuse admission to any of its classes or sessions. For example, if you are unwell (ie. colds, sore throats and chest infections, viruses) you will not be allowed to exercise.?
32. Richard Clarke Health and Fitness classes on Bank Holidays may be cancelled, changed to another day and or by time.
33. Members email addresses occasionally block incoming emails, and Richard Clarke Health and Fitness emails may not reach your inbox. This is not the responsibility of Richard Clarke Health and Fitness, however notices are placed on the website and Facebook regularly.
34. Members must comply with any amendments made to these Rules and Regulations.?
35. Should any member require any specific medical aids or otherwise (e.g., inhaler, supports etc.), it is up to that member to disclose this information to the instructor prior to each class, and ensure that they have it with them. This member may not be allowed to train without it.?
36. If a member arrives late to any class, they may not join in without notifying the instructor as they will not be insured. Members may not be allowed to participate for their own safety and the safety of other members. No discounts will be given should this occur.
37. Classes, times and locations are subject to change and cancellation. In cases of cancellation alternatives locations will be offered.
38. No children may enter the gym whilst a class is taking place. Children over the age of 5 may sit in the office area in extreme circumstances however Richard Clarke Health and Fitness and cannot accept any responsibility for them or their behaviour, which if it becomes loud or unruly or creates disturbance for other members you will be asked to remove them.
39. These terms are governed by English & Welsh law and you can bring legal proceedings in respect of the products in the courts. ??Privacy Policy?We will, as part of our fulfilment of these terms and conditions, collect personal data about you in accordance with our privacy policy. ??Photo/Video Consent Policy?At Richard Clarke Health and Fitness we would like to use both photographs and video footage from sessions as part of our promotional material to build our presence across our various social media accounts, together with our website and our private mailing list. Photographs and video footage may also be used in our general marketing materials from time to time.?
We request that you give us permission to take photographs and/or video footage during and/or after sessions at our premises and use these in our printed materials and online content for publicity. This may include using the photographs and/or video footage for printed and digital publicity, social media, press releases and funding applications.
We will not collect and use Photograph and Video Data of you without your consent. For more information on how we process your personal data please see our privacy policy, a copy of which is available on our website.
You may exercise your right to revoke this consent at any time by contacting us at (Insert your email) with your name and studio location. Revocation will not render any prior use with your permission unlawful.
By accepting these terms and conditions you hereby give us consent for Richard Clarke Health and Fitness Limited from time to time of (details of which are available on request) to take photographs and/or video footage of you and use them as set out above. All rights in the images resulting from the photographs and/or video footage, including any use, reproductions or adaptations belong to Richard Clarke Health and Fitness.
