Annual Upfront Membership
Group Personal Training
1. Definitions
1.1 "GPT" means Group Personal Training, of 15 Headley Road, Unit 6, Woodley, Berkshire, RG5 4JB.
1.2 "Member" means the individual who has purchased the Annual Upfront Membership.
1.3 "SGPT" means a semi-private group training session delivered by GPT.
1.4 "Standard Monthly Rate" means £160 per calendar month, being the published rolling monthly price for 2x per week SGPT membership at the date of purchase.
1.5 "Membership Term" means the 12 consecutive calendar months for which the Annual Upfront Membership is purchased.
1.6 "Written Notice" means notice sent by email to michael@grouppt.co.uk. Notice is treated as received on the day it is sent.
2. Membership Overview
2.1 The Annual Upfront Membership provides 12 consecutive calendar months of access to 2x per week SGPT for a single upfront fee of £1,600.
2.2 The Membership Term runs from the first day of a calendar month to the last day of the twelfth calendar month.
2.3 Where a Member joins part-way through a calendar month, a pro-rata payment is taken for the remainder of that month, calculated as £160 x (number of remaining days ÷ total days in that month). The Membership Term then begins on the first day of the following calendar month.
Example: a Member joining on 15 March pays a pro-rata fee for 15 to 31 March. The £1,600 annual fee is then payable on 1 April, and the Membership Term runs from 1 April to 31 March the following year.
2.4 Membership is personal to the Member and cannot be transferred, shared, or sold to another person.
3. Payment
3.1 The full annual fee of £1,600 is payable in advance.
3.2 No partial payments or instalments are permitted under this membership type.
3.3 Any pro-rata joining payment under clause 2.3 is payable at the point of purchase and is separate from the £1,600 annual fee.
4. Cooling-Off Period
4.1 Members have a 14-day cooling-off period from the date of purchase, in line with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
4.2 If the Member has not attended any sessions during this period, a full refund of all sums paid will be issued.
4.3 If the Member has attended one or more sessions during this period, GPT will deduct a pro-rata charge for the days elapsed, calculated as £160 x (number of days elapsed ÷ total days in that month). The remainder will be refunded.
Example: a Member who purchases on 1 June and cancels on 10 June, having attended sessions, is charged 9 ÷ 30 x £160 = £48. The balance of £1,552 is refunded.
5. Cancellation by the Member After the Cooling-Off Period
5.1 Members may cancel their Annual Upfront Membership at any point during the Membership Term by giving Written Notice.
5.2 Upon cancellation, the membership is re-priced at the Standard Monthly Rate of £160 for every calendar month used.
5.3 The refund is calculated as: £1,600 less (£160 x number of months used).
5.4 The refund will not fall below £0. Where the calculation produces a figure of £0 or less, no refund is due and no further payment is owed by the Member.
5.5 Where cancellation occurs after the refund has reduced to £0, access continues to the end of the Membership Term. GPT will not terminate access that has already been paid for.
5.6 Any refund due will be processed within 14 days of the cancellation being confirmed, using the original payment method.
6. Notice Period
6.1 One calendar month’s Written Notice is required to cancel the membership.
6.2 The notice period runs from the first day of the calendar month following the month in which notice is given.
6.3 Membership access continues throughout the notice period.
6.4 The notice period counts as a month used for the purposes of calculating any refund under clause 5.3.
Example: a Member gives notice on 12 July. Their notice period runs through August, and their membership ends on 31 August. If their Membership Term began on 1 March, they have used March through August inclusive, being 6 months. Their refund is £1,600 less (£160 x 6) = £640.
7. Freezes
7.1 Members may freeze their membership for up to 2 months in total during the Membership Term, in the event of serious illness, serious injury, hospitalisation, or relocation.
7.2 GPT may at its discretion extend a freeze beyond 2 months.
7.3 Freeze requests must be submitted in advance in writing and cannot be applied retrospectively.
7.4 The Membership Term end date is extended by the length of the freeze period. No time is lost.
7.5 Frozen months do not count as months used for the purposes of calculating any refund under clause 5.3.
7.6 No refunds are provided in respect of freeze periods, as the time is added to the Membership Term rather than deducted from it.
8. Studio Closures
8.1 The Standard Monthly Rate is calculated on the basis of 50 trading weeks per year, not 52.
8.2 GPT may therefore close the studio for up to 2 weeks per year. This allowance covers bank holidays and the Christmas period.
8.3 Closures falling within this 2-week allowance are included within the membership fee. No refund, credit, or extension is due in respect of them.
8.4 Closure dates are published in advance.
9. Sessions GPT Is Unable to Deliver
9.1 Where an individual session cannot be delivered and no cover coach is available, GPT will offer the Member a make-up session in an alternative slot within 14 days.
9.2 Where the studio closes beyond the allowance in clause 8.2, and the closure lasts 4 consecutive weeks or less, the Membership Term end date will be extended by the length of the closure.
9.3 Where GPT is unable to deliver in-person sessions for more than 4 consecutive weeks, and is unable to offer a substitute arrangement acceptable to the Member, the Member may request a pro-rata refund of the unused portion of the membership. This refund is calculated at the annual daily rate under clause 10.2.
9.4 Clauses 9.1 to 9.3 apply regardless of the cause of the non-delivery, including events outside GPT’s reasonable control.
10. Termination or Non-Delivery by GPT
10.1 Where GPT ends a membership, or is unable to deliver the membership as set out in clause 9.3, any refund is calculated at the annual daily rate. The re-pricing to the Standard Monthly Rate under clause 5.2 does not apply.
10.2 The annual daily rate is £1,600 ÷ 365 = £4.38 per day. The refund is the annual daily rate multiplied by the number of unused days remaining in the Membership Term.
10.3 This clause does not apply where the Member has chosen to cancel. In that case clause 5 applies.
11. Non-Refundable Circumstances
11.1 Refunds will not be issued for non-attendance or unused sessions where the sessions were available to the Member.
11.2 Refunds will not be issued for sessions missed due to travel, work, or personal commitments.
11.3 Nothing in this clause affects the Member’s right to cancel under clause 5, to freeze under clause 7, or their statutory rights.
12. Renewal
12.1 The Annual Upfront Membership does not automatically renew.
12.2 GPT will contact the Member before the end of the Membership Term to invite renewal. Renewal is arranged manually and requires the Member’s agreement.
13. Acceptance of Terms
13.1 By purchasing an Annual Upfront Membership, the Member confirms they have read, understood, and agreed to these Terms & Conditions.
13.2 Nothing in these Terms & Conditions affects the Member’s statutory rights.
