This membership bills every month. The first payment is due on the membership's start date. This membership entitles the purchaser to a full or partial discount on events/classes offered by the business. Some classes/events may be excluded from this membership. Unless otherwise noted, this membership is non-transferable. Your payment details will be securely stored in our system for the duration of the membership.

1. AGREEMENT
1.1 These Terms & Conditions form a legally binding agreement between you (“Member”) and [OFH Hub] (“the Studio”).
1.2 By purchasing any Membership or Service, you confirm you have read, understood, and agree to be bound by these Terms.
1.3 The Studio reserves the right to amend these Terms where reasonably necessary. Updated terms will be made available in writing and/or online.

2. MEMBERSHIP STRUCTURE
2.1 All recurring memberships operate on a minimum initial term of three (3) months.
2.2 The minimum term commences on the date of the first successful Direct Debit payment.
2.3 During the minimum term, membership may not be cancelled except:
Under the statutory 14-day cooling-off period (Section 4), or
In approved long-term medical circumstances (Section 10).

2.4 Upon expiry of the minimum term, membership automatically continues on a rolling monthly basis unless cancelled in accordance with Section 5.

3. PAYMENT TERMS
3.1 All memberships are payable monthly in advance via Direct Debit.
3.2 The Member authorises the Studio (or its nominated FCA-regulated Direct Debit provider) to collect payments as they fall due.
3.3 Payments are due regardless of attendance, usage, holiday, or personal circumstances.
3.4 Failed Payments:
Access will be suspended immediately upon failed payment.
An administration fee of £25 may be applied.
Outstanding sums must be settled within 7 days.
Continued non-payment may result in termination and referral to debt recovery.

3.5 Debt Recovery:
If any payment remains unpaid for more than 14 days:
The Studio may refer the matter to a debt recovery agency.
The Member will be liable for all reasonable recovery costs.
Interest may be charged at 4% above the Bank of England base rate.

3.6 The Studio reserves the right to increase pricing upon 30 days’ written notice. No increase will apply during the initial minimum term.

4. STATUTORY COOLING-OFF PERIOD
4.1 Where membership is purchased online or remotely, the Member has 14 days to cancel under the Consumer Contracts Regulations 2013.
4.2 If Services have commenced during this period, the Studio may deduct a proportionate charge for Services provided.
4.3 Cancellation must be submitted in writing to: [suzi@optimsingfemalehealth.com].

5. CANCELLATION (POST MINIMUM TERM)
5.1 After completion of the 3-month minimum term, membership may be cancelled by providing one full calendar month’s written notice.
5.2 Notice must be submitted via email.
5.3 The final payment will be collected during the notice period.
5.4 Verbal notice is not valid.

6. MEMBERSHIP FREEZE
6.1 Freeze requests require one full calendar month’s written notice.
6.2 Freezes:
Minimum duration: 1 month
Maximum: 3 months per calendar year
Not permitted during the initial minimum term (except medical grounds)

6.3 During freeze:
Payments are suspended after the notice period
Access is suspended
The minimum term is extended by the freeze duration

6.4 The Studio reserves discretion to approve or refuse freeze requests.
7. CLASS BOOKINGS
7.1 All class-based training sessions must be booked in advance via the Studio’s designated booking system.
7.2 Spaces are limited and allocated on a first-come, first-served basis.
7.3 A confirmed booking constitutes a reserved space within a structured coaching environment. As such, cancellation terms apply strictly.

7.4 Class / Open Gym Cancellation Policy
A minimum of 12 hours’ notice is required to cancel a class / open gym booking.
Cancellations made within 12 hours of the scheduled start time will result in forfeiture of the session credit.
Failure to attend a booked session (“no-show”) will result in forfeiture of the session credit.

7.5 Repeated late cancellations or non-attendance may result in temporary booking restrictions at the Studio’s discretion.
7.6 The Studio reserves the right to amend class timetables, instructors, or session formats where reasonably necessary for operational, safety, or quality control reasons.
7.7 Where a class is cancelled by the Studio, Members will:
Have the session credit reinstated; or
Be offered an alternative session where reasonably available.

7.8 The Studio does not guarantee availability of specific class times, coaches, or formats.


8. UNUSED SESSION CREDITS
8.1 Any unused credits on Open Gym, Signature or Elite memberships do not roll over. It is a “use it or lose it “ model.

9. HEALTH DECLARATION & PAR-Q
8.1 All Members must complete a Physical Activity Readiness Questionnaire (PAR-Q) prior to participation.
8.2 Members warrant that:
They are medically fit to undertake exercise.
All relevant medical information has been disclosed.
They will immediately inform the Studio of any health changes.

8.3 Where medical clearance is recommended, written GP approval must be provided.
8.4 The Studio reserves the right to refuse participation where health concerns exist.

10. ASSUMPTION OF RISK & LIABILITY
9.1 Exercise carries inherent risks including, but not limited to, musculoskeletal injury, cardiovascular events, and accidents.
9.2 Members voluntarily accept these risks.
9.3 Nothing in this Agreement excludes or limits liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any liability which cannot legally be excluded under UK law

9.4 Subject to the above, the Studio shall not be liable for:
Injuries arising from failure to follow instruction
Misuse of equipment
Undisclosed medical conditions
Loss or theft of personal property

9.5 Members agree to indemnify the Studio against claims arising from breach of this Agreement or negligent conduct.

11. MEDICAL SUSPENSION OR TERMINATION
10.1 Long-term medical incapacity (3+ months) may qualify for early termination.
10.2 Written medical evidence from a GP or consultant is required.
10.3 Short-term injuries will normally qualify for freeze only.
10.4 Approval remains at the Studio’s discretion.

12. MEMBER CONDUCT
The Studio maintains a private, premium training environment.
Members must:
Behave respectfully at all times
Follow staff instruction
Not attend under the influence of drugs or alcohol
Use equipment appropriately

The Studio may terminate membership immediately for serious misconduct. No refund will be issued.

13. INTELLECTUAL PROPERTY
All training programmes, materials, branding, and content remain the intellectual property of the Studio.
Members may not reproduce, distribute, or use materials for commercial purposes.

14. DATA PROTECTION
The Studio complies with:
UK GDPR
Data Protection Act 2018

Data is processed lawfully and securely. Members may request access to personal data at any time.

15. FORCE MAJEURE
The Studio is not liable for interruption due to events beyond reasonable control, including government restrictions.
No refunds will be issued for temporary closures beyond the Studio’s control. Reasonable alternative services may be offered at discretion.

16. GOVERNING LAW
This Agreement is governed by the laws of England & Wales.
